Right to delete data
The interested party will have the right to have the Data Controller delete their data, when:

  • The treatment is illegal.
  • The interested party has withdrawn his consent.
  • They are no longer necessary in relation to the purposes for which they were collected or treated.
  • The data subject has exercised the right of opposition and no other legitimate reasons for the treatment prevail.
  • The data must be deleted in order to fulfill a legal obligation of the Manager
  • The data subject will not have the right to have the Data Controller delete his/her data when the processing is necessary.
  • To exercise the right to freedom of expression and information.
  • To fulfill a legal obligation of the Manager.
  • For the formulation, exercise or defense of claims.
  • For the public interest based on current legislation for reasons of public health or for the purposes of historical, statistical or scientific research.
  • Data Portability Right
    The Data Controller has the right to transmit his/her data to another Data Controller or to the data subject, using a structured format commonly used and machine readable, when the processing is carried out by automated means and is based on:
  • The consent of the interested party for specific purposes.
  • Execution of a contract or pre-contract with the interested party.

The right to data portability will not apply when:

  • Transmission is technically impossible.
  • They may adversely affect the rights and freedoms of others.
  • The treatment has a public interest mission based on current legislation.

Right to Limit Treatment
The interested party will have the right to object to the processing of their data carried out by the Manager for reasons related to their particular situation, when the processing is based on:

  • Direct marketing.
  • Profiling.
  • Legitimate interest of the Supervisor or third parties, provided that the interests or rights and freedoms of the data subject do not prevail, especially if it is a child.
  • Historical, statistical, or scientific research, unless treatment is necessary for reasons of public interest.

Even if the data subject opposes the processing of his data, the Data Controller may continue to process them as long as the legitimate interest of the Data Controller prevails over the interests or the rights and freedoms of the data subject in a judicial procedure that justifies it.
The Manager must inform the interested party of the right to object to the processing of their data in an explicit, clear and separate manner from any other information, at the time of the first communication.

Opposition law
It is the right not to carry out any treatment of these or to cease in the same when it is not necessary his consent for the treatment, for the concurrence of a legitimate and well-founded reason, referred to his concrete personal situation , which justifies it, and provided that a Law does not provide otherwise.

Right not to be profiled
The interested party will have the right not to be subject to profiling, the purpose of which is to make individual decisions based on automated data processing and intended to evaluate, analyze or anticipate the following personal aspects:

  • Professional performance.
  • Economic situation.
  • Personal preferences or interests.
  • Location or movements of the person.

When profiling is based solely on automated processing:

The interested party will have the right to be informed if the decision that may be taken could have legal effects that would significantly affect him.
The data subject will have the right to obtain human intervention from the person in charge, to express his / her point of view and to challenge the decision, if the treatment has been authorized by:

  • A contract between the Manager and the interested party.
  • Explicit consent of the interested party.

The right not to be subject to profiling will not apply when the decision that may be taken as a result of the profiling is authorized by:

  • Explicit consent of the interested party.
  • A contract between the Manager and the interested party.
  • A treatment based on current legislation.
